AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and VerifyMall, LLC ("Company," "we," "our," or "us") concerning your access to and use of the verifymall.com website and any related services (collectively, the "Service").

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using VerifyMall, you acknowledge that:

• You have read and understood these Terms
• You agree to be bound by these Terms
• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

2. DESCRIPTION OF SERVICE

VerifyMall is a marketplace verification platform that provides identity verification services to facilitate trust between users engaged in online transactions.

2.1 Verification Services Offered

• Email Verification: Confirms access to an email address
• Phone Verification: Confirms access to a phone number via SMS
• Payment Verification: Validates payment method ownership
• Identity Document Verification: Reviews government-issued identification

2.2 Nature of Verification

NO ONGOING MONITORING: Verification is a one-time or periodic check. We do not continuously monitor users or guarantee their ongoing behavior, identity, or trustworthiness.

FRAUDULENT INFORMATION: Users may provide false, stolen, or fraudulent information despite our verification processes. Our verification services cannot detect all forms of fraud, identity theft, or misrepresentation.

3. NO WARRANTIES OR GUARANTEES

3.1 Express Disclaimer

WE MAKE NO WARRANTIES, GUARANTEES, OR REPRESENTATIONS REGARDING:

• The accuracy, completeness, or reliability of any user information
• The identity, credibility, or trustworthiness of any user
• The outcome of any transaction between users
• The prevention of fraud, theft, or criminal activity
• The quality, safety, or legality of any goods or services
• The performance or conduct of any user

3.2 Verification Limitations

YOU ACKNOWLEDGE THAT:

• Verification badges are indicators only, not guarantees
• Verified users may still engage in fraud, misrepresentation, or illegal activity
• Documents can be forged, stolen, or altered
• Identity theft and impersonation can occur despite verification
• Payment verification does not prevent chargebacks or payment disputes
• Email and phone verification can be circumvented
• Our review processes have limitations and are not infallible

4. LIMITATION OF LIABILITY

4.2 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

OUR TOTAL LIABILITY to you for any claims arising from or related to the Service, whether in contract, tort, or otherwise, SHALL NOT EXCEED the greater of:

• The amount you paid to us in the 12 months preceding the claim, OR
• $100 USD

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless VerifyMall, LLC from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your transactions with other users
• Your reliance on verification badges or services
• Any fraud, misrepresentation, or illegal activity you engage in

6. USER ACCOUNTS

To use certain features of the Service, you must create an account. You agree to provide accurate information and maintain account security.

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms or suspected fraud.

7. VERIFICATION FEES

7.1 Paid Verification Services

• Payment Verification: $5.00 (non-refundable)
• Identity Document Verification: $15.00 (non-refundable)

8. PROHIBITED CONDUCT

You agree NOT to:

• Provide false, misleading, or fraudulent information
• Use another person's identity or documents
• Submit stolen, forged, or altered documents
• Violate any laws or regulations
• Harass, threaten, or harm other users
• Attempt to hack or disrupt the Service

14. USER TRANSACTIONS

VerifyMall is not a party to any transactions between users. We do not facilitate, broker, complete, guarantee, or resolve disputes for transactions.

Users are solely responsible for their transactions, including negotiating terms, completing payment, resolving disputes, and complying with laws.

18. DISPUTE RESOLUTION

YOU AGREE THAT ANY DISPUTE arising from these Terms shall be resolved through binding arbitration, not court proceedings.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTIONS. Claims must be brought individually.
